La rédaction du testament

Avant notre départ au Canada, nous avons souhaité prendre la précaution de rédiger un testament pour désigner le tuteur légal de notre enfant en cas de décès durant le vol.

Nous nous sommes respectivement désignés au cas où seul l’un d’entre nous ne décèderait, puis nous avons choisi le frère de Mathieu qui est une personne de confiance et papa de deux enfants dans le cas où l’on décèderait tous les deux.

Selon le notaire, ce testament n’aurait aucune valeur juridique en France tant que la filiation n’était pas reconnue, d’autant plus que le bébé n’était pas encore né, mais cela avait malgré tout un côté rassurant pour nous dans la mesure où il y avait une trace écrite de notre souhait.

Before our departure to Canada, we wanted to take the precaution to draw up a will to designate the legal guardian of our child in the event of death during the flight.

We respectively designated each other in the event that only one of us died, and then we chose Mathieu’s brother, who is a support person and father of two children, in the event that we both die.

According to the notary, this will would have no legal value in France as long as the parentage was not recognized, especially since the baby was not yet born, but it still had a reassuring side for us in the as there was a written record of our wish.
